Perth’s Raffles Hotel noise complaint back in court

The noise complaint over loud music at Perth’s Raffles Hotel is heading back in court tomorrow.

Last November, WA mining millionaire Derek Noel Ammon, who has lived in one of the luxury apartments next door since 2009, claimed the venue breached noise limits.

In court documents, he alleged that venue owner, Colonial Leisure Group, “directed and allowed” staff to play music above allowable noise limits since at least 2014”, which caused “unreasonable interference to his health”.

He wants the internal bar and garden shut and Colonial Leisure to pay unspecified damages.

Colonial, which disputes the claim, had a win of sorts when the Supreme Court dismissed an attempt by Ammon last November for an interlocutory injunction to stop the beer garden from operating during the summer months until the case could be heard.

Raffles manager Tasmi Ashraf said the hotel "has a special place in the hearts of the people of Perth.

"It is a Western Australian icon with a long and colourful history that is important to the local and broader community - and it must be preserved.

"Colonial Leisure Group will, with the support of the community, vigorously defend the imposition of untenable restrictions on the operation.”
